Horses grazing in a misty field at sunrise

Buying, selling or keeping a horse in Italy involves contracts, veterinary checks, transport rules and liability issues that often differ from those in other countries. MILICIA LEX assists owners, buyers, sellers, breeders and riders, in Italy and abroad, with clear legal advice in English and Italian.

How I can help

  • Purchase and sale of horses. Drafting and reviewing sale contracts, conditions linked to the pre-purchase veterinary examination, payment terms and transfer of ownership.
  • Defects and disputes after the sale. Assessing claims for hidden defects or misrepresentation, and negotiating a solution before litigation.
  • Boarding, training and lease agreements. Clear contracts for livery yards, trainers and horse leasing, covering fees, responsibilities and termination.
  • Breeding agreements. Stallion services, mare arrangements, foal ownership and registration.
  • International transfers. Checking all the documents when a horse bought in Italy has to travel to another country, or comes to Italy from abroad: identification and equine passport, health certificates and transport paperwork, within the EU and beyond. If you cannot be in Italy for the sale, a power of attorney lets me act on your behalf.
  • Liability and insurance. Owner and keeper liability for damage caused by horses (Article 2052 of the Italian Civil Code) and review of insurance cover.

Why it matters

A horse is a significant investment. In Italy, several aspects of a sale, such as warranties for defects, follow specific rules and short deadlines. Getting the contract right from the start avoids costly disputes later.
